I'd concur with this. HR > Lawyers. Being as you're in the states, I should imagine there's oodles of laws against it. I'd say go to HR first and if you're not happy with the action they take (i.e., they don't at least start an investigation/ sack her on spec) then proceed to the properly judicial system. People doing that sort of thing shouldn't be allowed jobs. They should find one of the legion of over-qualified immigrants/ minorities to do it instead.
